Sammendrag
Tittelen på min oppgave er ”Gjennomgang og analyse av saksstatistikk og rettspraksis ved
jordskifteoverrettene” som også er hovedproblemstillingen min. Jeg vil i mitt studie,
undersøke jordskifteoverrettens saksutvikling i perioden 2000-2010, hvor jeg skal
sammenligne min statistikk over jordskifteoverrettenes saksutvikling med utviklingstrekk i
samfunnet, og jordskifterettens statistikk fra samme periode.
Jeg har også vært interessert i å undersøke nærmere ulike problemstillinger som oppstår i
jordskifterettens vurderinger og som ofte er gjenstand for anke. Problemstillinger jeg skal
vurdere nærmere ved hjelp av rettsavgjørelser er:
- ved fremme av sak
- ved uforming av skiftefelt
- hvordan skille jordskifte fra ekspropriasjon
- kostnadsfordeling ved overjordskifte
Dette er problemstillinger som skal behandles av jordskifteoverrett. Innenfor de ulike
situasjonstilfellene som vist overfor, skal jeg se nærmere på problemstillinger hvor
jordskifteoverretten, med støtte i lagmannsrett og høyesterett har illustrert hva lovgiver har
ment og lagt føringer for fremtidig saksbehandling i jordskifte(over)retten.
Rettsmiddelordningen i jordskifteloven er et tosporet system, hvor jordskifteoverretten deler
kompetanse med lagmannsretten i å håndtere anke over jordskifterettens avgjørelser.
Jordskiftelovens § 61 regulerer til hvilken instans anken skal realitetsbehandles i, men det
forekommer tilfeller hvor anker kommer inn til feil ankeinstans. I den forbindelse ønsker jeg å
undersøke ”kompetansedelingsregelen”, og til slutt vil jeg vise eksempler på rettspraksis hvor
anker blir sendt til feil instans. Jeg vil se hva som er konsekvensene av dette og hva som
eventuelt vil komme til å skje i det jordskifteoverrettene en gang blir slått sammen med
lagmannsretten, slik som forseslått i Høringsnotatet for ny jordskiftelov.
Beskrivelse
The title of this paper, which also encapsulates the main issue of its inquiry, is "Review and
analysis of case statistics and the case law of the land consolidation court of appeal".
The purpose of this study is to examine the development of the land consolidation court of
appeal’s case law from 2000 to 2010. More specifically, I will compare statistics on the
development of the case law of the land consolidation court of appeal to the development with
trends in society, and also to land consolidation court's statistics from the same time period.
Furthermore, I have also been interested in investigating various issues arising in the land
consolidation court assessments, which are often subject to appeal. Reviewing relevant case
law, I endeavor to discuss the following topics:
- by promoting the cause
- by designing the replacement field
- how to separate the soil change from expropriation
- cost distribution of land consolidation
These are issues to be dealt with by the land consolidation court. With regards to these issues,
I will discuss more specifically questions raised in the context where the land consolidation
court of appeal, with the support of the High Court and Supreme Court, has illustrated what
the legislature has intended and added guidance for future proceedings in the land
consolidation court or the land consolidation court of appeal. The system of appeal provided
in the Land Consolidation Act is a two-track system, where land consolidation court shares
competence with the High Court to handle appeals of land consolidation court decisions. The
Land Consolidation Act § 61 stipulates which court the appeals must be handled by, but there
are examples that the appeals have been sent to the wrong court. In this regard I wish to
examine the rule concerning competence, and finally I will present examples of cases where
appeals are sent to the wrong court. I will discuss the consequences of this, and what will
eventually happen when the land consolidation court of appeal will be merged with the High
Court, as proposed in front consultative document for the new act of land consolidation.
