dc.description.abstractBrann- og redningsvesenets rolle som en kommunal samfunnsikkerhetsaktør kan påvirke og påvirkes av den kommunale arealplanleggingen. Kommunen har en todelt rolle som overordnet aktør: rollen som planmyndighet og rollen som brannmyndighet. Hvordan kommunen forvalter denne rollen vil avhenge av tilgjengelige verktøy, ressurser, lovverk og medvirkning. I tillegg legger det kommunale selvstyre en klar føring for særegne stedstilpasninger der kommunen bør ta en aktiv rolle rundt risikoaksept og hvordan dette inkorporeres i planverket. Oppgavens problemstilling: Hvordan påvirker kommunens selvstyre innenfor planlegging brannberedskapen, og kan en økende bruk av interkommunale brannsamarbeid forandre denne påvirkningen? For å besvare problemstillingen blir det også nødvendig å kartlegge: Hvilke planverktøy finnes, og på hvilket plannivå er det mest hensiktsmessig at brann- og redningsvesenet samt andre involverte beredskapsaktører inkluderes i planarbeidet etter plan- og bygningsloven? Det har blitt gjennomført en omfattende litteraturstudie av lovverk, stortingsmeldinger, veiledere og ulike rapporter. Litteraturstudien har blitt kontrollert gjennom en intervjuprosess med utgangspunkt i Hamar-regionen (Hamar- Stange- Løten- og Ringsaker kommune). Totalt har seks ulike aktører både med nasjonal, regional og lokal tilknytning blitt intervjuet. Gjennom litteraturanalysen og intervjuene har jeg undersøkt brann- og redningsvesenet inkludering i kommunens planprosesser, og hvordan de medvirker i utarbeidelsen av kommunens helhetlige risiko- og sårbarhetsanalyse. Videre har det blitt sett på om denne inkluderingen påvirkes av kommunens selvstyre og forvaltningsskjønn, og om bruken av interkommunale brannsamarbeid innvirker på brann- og redningsvesenets medvirkning. For å besvare problemstillingen har det vært viktig å undersøke alle plannivåene fra statsforvalteren sin risiko- og sårbarhetsanalyse for fylket, og ned til byggesak med kommunens kontroll- og tilsynsmyndighet. Oppgaven konkluderer med at brann- og redningsvesenet i for liten grad inkluderes i kommunens planprosesser, og at dette både kan skyldes ressursmangel i kommunene, men også hvilket system kommunen har for inkludering av relevante aktører etter plan- og bygningsloven. Tematikken som blir presentert i oppgaven deles mellom tre lovverk: plan- og bygningsloven (2008), sivilbeskyttelsesloven (2010) samt brann- og eksplosjonsvernloven (2002). Tredelingen av lovverket med dels ulike ansvarlige departementer kan skape konfliktområder der regelverket kan være vanskelig å tolke grunnet for lav samhandling. Brann- og redningsvesenet har ikke innsigelsesmyndighet innenfor plan- og bygningsloven og er derfor avhengig av inkludering gjennom planprosessen. Innenfor caseområdet opplevde brann- og redningsvesenet derimot at de i stor grad ble inkludert uavhengig av kommunens interne medvirkningsprosess. Hamar kommune sin modell med et internt planforum ble likevelforetrukket. I forhold til medvirkning ved utarbeidelse av kommunens helhetlige risiko- og sårbarhetsanalyse var det derimot større ulikheter innenfor caseområdet. Det foreligger et sterkt ønske blant aktørene innenfor fagfeltet om å gjennomføre en ny stortingsmelding vedrørende brannberedskap og brannvern. Siste stortingsmelding kom for 12 år siden, og det har skjedd en rekke teknologiske, strukturelle og økonomiske endringer siden 2009. I forkant av arbeidet med ny stortingsmelding, og basert på funnene i denne oppgaven presenteres derfor følgende anbefalinger: En ny stortingsmelding innenfor brannberedskap og brannvern må ta innover seg de pågående forandringene og konfliktene som har blitt beskrevet. Dette inkluderer elementer som (forkortet): * Hvilken påvirkning KMD sitt høringsnotat (2021) kan få for brann- og redningsvesenet sin inkludering i kommunens planprosesser. * Hvordan kan den pågående utredningen omhandlende kommunens organisering etter generalistprinsippet påvirke brann- og redningsvesenet? * Justis- og beredskapsdepartementet og DSB sin klargjøring av regelverket i etterkant av brannkum-sakene i Asker kommune vil i hovedsak gjelde slokkevannproblematikken. En ny stortingsmelding må løfte debatten ved å se på regelverket som en helhet og vurdere brann- og redningsvesenet sin medvirkning over flere plannivåer. * Hvordan kan brann-og redningsvesenet brukes som en fagressurs ved kommunes kontroll av eksterne risiko- og sårbarhetsanalyser etter plan- og bygningsloven §4-3? * Inkluderingen av den pågående debatten rundt kommunes kontroll av planlagte og eksisterende byggverk, og bruken av private ressurser. I tillegg presenteres følgende spesifikke tiltak (forkortet): * Bruken av interne planforumer som illustrert ved Hamar kommune. * Økt fokus på brann- og redningsvesenet sine egne veiledere som et kunnskapsgrunnlag i planprosessen, gitt dagens varierende inkludering av brann- og redningsvesenet direkte. * Anbefaling om videre undersøkelser vedrørende muligheten for innsigelsesmyndighet for brann- og redningsvesenet som i en økende grad regional aktør.
dc.description.abstractThe role of the fire and rescue service as a civil protection actor can both influence and be influenced by the local spatial planning. The municipality has a twofold role as the overriding actor: the role as a planning authority and the role as a fire authority. How the municipality manages this role will depend on available planning tools, resources, legislation and participation. In addition, the municipal autonomy creates guidelines for specific site adaptations where the municipality should take an active role around risk acceptance. Another question is how this is incorporated into the planning. The master thesis will shed light on the following questions. How does municipal autonomy affect fire preparedness, and can an increasing use of inter-municipal fire cooperation change this influence? In order to answer the problem, it will also be necessary to map: What planning tools are available, and at what planning level is it most appropriate for the fire and rescue service and other emergency actors to be included in the planning process? An extensive literature study has been carried out to map legislation, guidelines and various reports. The literature study has been checked through an interview process with regards to a preselected area: Hamar, Stange, Løten and Ringsaker municipality. A total of six different actors with national, regional and local connections have been interviewed. Through the literature study and the interviews, I have investigated the fire and rescue service's inclusion in the municipality's planning processes, and how they participate in the preparation of the municipality's comprehensive risk and vulnerability analysis. Furthermore, it has been looked at whether this inclusion is affected by the municipality's autonomy and administrative discretion. Can the use of inter-municipal fire cooperation affect the fire and rescue service's participation? In order to answer the thesis, it’s been crucial to examine all the planning levels from the state administrator's risk and vulnerability analysis, and down to the specific construction case. The paper concludes that the fire and rescue service is not sufficiently included in the municipality's planning processes, and that this may be due to a lack of resources in the municipalities. The legislation is divided into three parts with partly different responsible ministries. This can create areas of conflict where the regulations can be difficult to interpret due to low interaction. The fire and rescue service does not have the authority to object within plan- og bygningsloven, and is therefore dependent on inclusion throughout the planning process. Within the case area the fire and rescue service, on the other hand, experienced that they were largely included regardless of the municipality's internal participation process. Hamar municipality's model with an internal planning forum was nevertheless preferred. In relation to participation in the preparation of the municipality's comprehensive risk and vulnerability analysis, however, there were greater differences within the case area. There is a strong desire among the actors in the field to implement a new national report regarding the fire and rescue service. The last main report came out 12 years ago, and a number of technological, structural and economic changes have taken place since then. Prior to the work on the main report, and based on the findings in this thesis, the following recommendations are presented: * What impact can the Ministry of Local Government and Modernizations consultation memorandum (2021) have on the fire and rescue service's inclusion in the municipality's planning processes? * How can the ongoing report on the municipality's organization according to the generalist principle affect the fire and rescue service? * The Ministry of Justice and Emergency Preparedness and the Directorate for Civil Protection and Emergency Planning's clarification of the regulations in the wake of the fire hydrant cases in Asker municipality will mainly apply to the fire water problem. lift the debate by looking at the regulations as a whole and assessing the fire and rescue service's participation across several planning levels. * How can the fire and rescue service be used as a specialist resource in the municipality's control of external risk and vulnerability analyzes according to the plan- og bygningsloven §4-3? * The inclusion of the ongoing debate regarding the municipality's control of planned and existing buildings, and the use of private resources In addition, the following specific measures are presented (shortened): * The use of internal planning forums as illustrated in Hamar municipality * Increased focus on the fire and rescue service's own supervisors as a knowledge base in the planning process, given today's varying inclusion of the fire and rescue service directly. * Recommendation for further investigations regarding the possibility of an objection authority for the fire and rescue service as an increasingly regional player
