dc.description.abstractTema for denne masteroppgaven er utbyggingsavtaler etter plan- og bygningsloven kapittel 17, med fokus på hvilke lovmessige krav kommunen stiller i praksis. Ved å undersøke et utvalg av utbyggingsavtaler, er målet å finne ut hvilke krav kommunen stiller til utbygger, og om kravene ligger innenfor lovens rammer. Utbyggingsavtaler brukes i dag som et viktig virkemiddel for å sikre at det skjer en helhetlig utvikling i større områder der det kreves kommunal infrastruktur. Dette reiser imidlertid en del utfordringer med tanke på motstridende interesser mellom kommune og utbygger. Før lovendringen i 2005, utviklet det seg en praksis hvor urimelige avtaler ble inngått og hvor det var misbruk av kommunal planmyndighet. Med lovendringen ble det satt begrensninger for hvilke krav kommunen kunne stille i utbyggingsavtalene. Ny rettspraksis viser imidlertid at utbygger mener kommunen stiller krav basert på ønsker, uten særlig grunnlag for behov. For å finne ut om de lovmessige kravene følges i praksis, har det vært hensiktsmessig å gjøre et dokumentstudie av utbyggingsavtaler i Oslo kommune. På denne måten kan man se om kommunen faktisk forholder seg til de begrensninger loven gir. Kartleggingen av gjeldende rett viser at loven begrenser kommunens adgang til å stille krav i utbyggingsavtaler etter plan- og bygningslovens kapittel 17. Samtidig har kommunen fritt skjønn innenfor de rammer loven gir, og kan selv vurdere om kriteriene i plan- og bygningsloven § 17-3 tredje ledd er til stede. Vi har tidligere lite rettspraksis på området, men resultat fra ny dom i Høyesterett viser imidlertid at kommunen stiller krav utenfor lovens rammer, basert på ønsker uten grunnlag for behov og saklig tilknytning til utbyggingsområdet. Dokumentstudiet av utbyggingsavtaler i Oslo kommune viser at kommunen stiller høye krav, men disse ligger stort sett innenfor lovens rammer basert på gjeldende rett. Funnet indikerer at det er en forståelse fra kommunens side at disse vilkårene må være til stede.en_US
dc.description.abstractThe theme of this master thesis is development agreements from the plan and building act chapter 17, focusing on what legal requirements the municipality sets in practice. By examining a sample of development agreements, the goal is to find out what legal requirement the municipality sets, and if the requirements are within the framework of the law. Development agreements are currently used as an important tool to ensure that holistic development in larger areas where municipal infrastructure is required. However, this raises several challenges concerning conflicting interests between the municipality and the developer. Before the change in the law in 2005, a practice had developed where unreasonable agreements were entered and there was abuse of the municipal planning authority. With the change in the law, restrictions were set for what requirements the municipality could set in the development agreements. However, new case law shows that the the developer believes the municipality makes demands based on wishes, without any particular basis for need. To find out whether the legal requirements are followed in practice, it has been appropriate to conduct a document study of development agreements in Oslo municipality. In this way, one can see whether the municipality relates to the restrictions provided by the law. Clarification of applicable law shows that the law restricts the municipality’s right to set requirements in development agreements according to chapter 17 of the Planning and Building Act. At the same time, the municipality has free discretion within the limits provided by the law and can assess whether the criteria according to the Planning and Building Act § 17-3 third section are present. There has previously been little case law in the area, but a new ruling from the Supreme Court shows that the municipality sets requirements outside the law, based on wishes without a basis for need and factual connection to the development area. Document studies of development agreements in the municipality of Oslo show that the municipality sets high standards, but these appear to be within the framework of the law. The finding indicates that the municipality understands that these criteria must be present.en_US
