dc.description.abstractTemaet for oppgaven er å drøfte spørsmål om festerens rett til å kreve endring av formål i festeavtaler. Oppgaven tar utgangspunkt i et spesifikt tema som har kommet opp i personlig henseende. Det er likevel trolig at oppgavens problemstilling er relevant for flere festere og grunneiere rundt om i landet. Valg av festeformål har blant annet betydning for spørsmål rundt fastsettelse av festeavgift, forlenging og innløsning. I Norge finnes det over 200 000 festeforhold, hvorav omlag 170 000 er til bolig- eller fritidshus. Det opprettes få nye festeforhold i nyere tid, men det er likevel en stor andel norske huseiere og bedrifter som fester tomt fremfor å eie. Det er derfor et aktuelt tema som flere ganger har vært fremmet i Høyesterett. Oppgaven belyser festers og bortfesters rettigheter ved tomtefeste og hvilke argumenter og hensyn som skal vektlegges ved en eventuell mulighet for at fester skal kunne kreve endret festeformål fra næring til bolig- eller fritidshus.en_US
dc.description.abstractThe theme of this thesis is to discuss questions around the lessee`s right to demand a change of the purpose in a leasehold estate agreement. The thesis is based on a specific topic that has arisen in personal terms. It is nevertheless probable that the problem of the thesis is relevant to several lessee´s and landowners. The choice of purpose of the leasehold is important, among other things, for questions regarding the determination of leasehold rent rate, extension, and redemption. There are more than 200 000 leasehold estate agreements in Norway, of which about 170 000 are for residential or holiday homes. Few new leasehold estate agreements have been established in recent times, but there is still a large proportion of Norwegian homeowners and companies who lease land rather than owning it. Therefore, it is therefore a relevant topic that has been raised several times in the Norwegian Supreme Court. The thesis clarifies lessee and lessors´ rights in connection with a plot of land and which arguments and considerations must be emphasized in the event of a possibility for lessee to be able to demand a change of purpose of the leasehold from industry to residential or holiday homes.en_US
