Fordelen med forhandlinger i anskaffelsesprosessen : en case-studie av Nydalsbrua i Trondheim

Abstract

I denne oppgaven ser jeg på hvordan konkurranse med forhandlinger (KMF) passet til prosjekt Nydalsbrua, som Statens Vegvesen (SVV) er ansvarlig for. KMF er en av flere anskaffelsesprosedyrer som kan benyttes for større og utfordrende prosjekter. Et typisk trekk ved KMF er at byggherren selv, eller ved hjelp av rådgivere, definerer og utarbeider konkurransegrunnlaget.. Dette spesifiserer arbeidsomfanget og inneholder de kontraktuelle betingelsene. Konkurransegrunnlaget adresserer krav om gode prinsipper for prosjektgjennomføring og identifiserer bygge og anleggskontrakt standarden NS 8405, som tradisjonelt er brukt for denne typen prosjekter. NS 8405 er en anerkjent standard blant industriaktørene og gir forutsigbare betingelser og bidrar til forskjellige aspekter av usikkerhetshåndtering som risiko og konsekvensreduserende tiltak. Premissene for å kunne benytte KMF er knyttet til omfang og kompleksitet av prosjektet. Prosjektet Nydalsbrua er lokalisert i et område med relativt liten utstrekning og med mange samtidige aktiviteter. Jernbanen skal operere uhindret og arbeidet skal i minst mulig grad være et hinder for annen trafikk, og dette kombinert med utfordringene til mer tradisjonelle veiprosjekter gjør at kriteriene for KMF er oppfylt. En liten kuriositet for dette prosjektet er arkitektkonkurransen for designet av brua, hvor den estetiske utformingen var viktig. AasJakobsen, som vant arkitektkonkurransen, prosjekterte brua og dette fant sted før anskaffelsesprosessen i dette case-studiet.

This thesis addresses to what degree the Competitive Procedure with Negotiation (herein abbreviated to KMF) suited the Nydalsbrua project. The Norwegian Public Roads Administration (herein abbreviated to SVV) is responsible for the project where KMF is one out of a few procurement procedures that can be used for larger and challenging projects. A typical feature of KMF is that the project owner, with support from selected consultants as required, will define and prepare the competitive basis. It covers the specified requirements to the scope and includes the contractual conditions. The competitive basis addresses sound project execution aspects, and the Norwegian building and civil engineering contract - NS 8405 is traditionally used for this type of projects. NS 8405 is a well-known and recognized standard among the stakeholders, which provides for predictability and regulates some of the uncertainty, risk and consequence control elements. To apply the KMF procedure, certain conditions will have to be satisfied to meet the Norwegian Public Procurement requirements. This is related to the scope and complexity of the project. The Nydalsbrua project is situated in a confined geographical area and exposed to several simultaneous construction activities. Important conditions that the project must accommodate is uninterrupted railway operation and minimal obstacles to other traffic in the area. When this is combined with the inherent challenges of more traditional road construction projects, it will imply that the criteria for KMF are met. A small curiosity for this project is the architectural competition for the design of the bridge, since the aesthetic design of this main component was emphasized as particularly important. The company Aas-Jakobsen won this competition and was assigned the design and issued the construction documentation for the bridge. This work took place before the procurement process, covered by this case study, started.
