dc.description.abstractTowns along the Norwegian coast are attractive places to live and visit, where access to the sea is an identity-creating quality and resource. Increasing centralization and population growth has contributed to the expansion and privatization of large parts of the center-based shoreline. This has been especially at the expense of public access to the shoreline. The tightening of the building ban in the Planning and Building Act of 2008 also made the construction ban applicable to towns, highlighting that general interests and public accessibility should also be ensured in urban areas. National guidelines are clear that centralization is a desirable development, which will emphasize high levels of land use and densification. The challenge for the municipalities is therefore to reconcile the considerations set out in the construction ban with this in urban development. This master thesis seeks to answer how public access to the shoreline has been secured in the area zoning plans for the towns Våge and Storebø in Sunnhordland. The study also looks at how towns are designed to integrate the shoreline as a quality that ensures accessibility. The towns are located in municipalities as in The national policy guidelines for a differentiated management of the 100-meter belt along the seashore (NPG) are categorized as Zone 3: Areas with less pressure on the area. This task seeks to answer how the municipalities use NPG and if the guides affect the safeguarding of public accessibility to the shoreline in the towns. The thesis also looks at how the construction ban is interpreted and followed up in the area zoning plans and whether the municipalities as a planning authority sufficient manages to secure public accessibility. In the research work, a qualitative study has been made based on literature and document study of the area zoning plans, as well as semi structured interviews. In the interview survey, four key informants who represent the actors in the planning processes were interviewed; The county governor in Hordaland, Hordaland County Municipality and one informant from each of the municipalities. The findings in the surveys show that the municipalities have not managed to sufficient secure public accessibility to the shoreline. The county governor promoted objection to both of the area zoning plans and thus became a defender of general interests and public accessibility in the towns. This was especially the case in Våge, where the area zoning plan led to the complete demolition and privatization of the shoreline on Vågsneset. The opposition led to "annen byggegrense" being set to 5 meters from the seashore by the Ministry of Local Government and Modernisation. The surveys shows that the both area zoning plans have managed to integrate the shoreline as a quality where public access has been ensured. Nevertheless, the findings show that the towns have an improvement potential that is strongly linked to areas not made available to the public. The area zoning plan for Storebø has, to a greater extent than Våge, managed to design a town that safeguards public accessibility. However, this has been at the expense of the shoreline by moving the settlement down to the seashore, rather than expanding beyond the 100-meter belt. The findings in the thesis show that NPG is a good tool in urban planning - if the guidelines are interpreted for its purpose. The findings, however, show that the municipalities emphasize the part that deals with a lower threshold for construction in the shoreline to its advantage. The surveys show that this has contributed to the fact that the municipalities have not sufficient managed to secure public accessibility to the seashore in the towns, and NPG appears as a liberalization of the construction ban. It also appears that the determination of "annen byggegrense" contributes to liberalize the construction bans purpose, in the sense that no state or regional guidelines are given for how to set this. The results of the thesis show that public accessibility to the shoreline was not sufficient secured in the area zoning plans for the towns of Våge and Storebø, mainly because the construction ban and NPG allows for interpretation. An interpretation that can be prevented by clearer regional and national guidelines.nb_NO
dc.description.abstractTettstedene langs den norske kyst er attraktive steder å bo og ferie, der tilgangen til sjøen er en identitetsskapende kvalitet og ressurs. Økende sentralisering og befolkningsvekst har bidratt til at store deler av sentrumsnær strandsone er utbygd og privatisert. Dette har særlig gått på bekostning av allmennhetens tilgang til strandsonen. Innstrammingen av byggeforbudet i Plan- og bygningsloven av 2008 gjorde byggeforbudet også gjeldende for tettsteder, og markerte med dette at allmenne interesser og allmenn tilgjengelighet også skal sikres i tettstedene. Nasjonale føringer er tydelig på at sentralisering er en ønsket utvikling, der blant annet høy arealutnyttelse og fortetting skal vektlegges. Utfordringen for kommunene er derfor å forene hensynene som fremgår i byggeforbudet med dette i tettstedsutviklingen. Denne masteroppgaven søker å besvare hvordan allmenn tilgjengelighet til strandsonen er ivaretatt i områdereguleringene for tettstedene Våge og Storebø i Sunnhordland. Studiet ser også på hvordan tettstedene er utformet for å integrere strandsonen som en kvalitet, der tilgjengelighet sikres. Tettstedene ligger i kommuner som i Statlige planretningslinjer for differensiert forvaltning av strandsonen langs sjøen (SPR strandsone) er kategorisert som sone 3: områder med mindre press på arealet. Denne oppgaven søker å besvare hvordan kommunene anvender SPR strandsone, og om føringene påvirker ivaretakelsen av allmenn tilgjengelighet til strandsonen i tettstedene. Oppgaven ser også på hvordan byggeforbudet i Pbl. § 1-8 blir tolket og fulgt opp i områdereguleringene, og hvorvidt kommunene som planmyndighet tilstrekkelig klarer å ivareta allmennhetens tilgjengelighet. I forskningsarbeidet er det gjort en kvalitativ studie basert på litteratur og dokumentstudie av områdereguleringene, samt semistrukturerte dybdeintervjuer. I intervjuundersøkelsen ble det intervjuet fire sentrale informanter som representerer aktørene i planprosessene; Fylkesmannen i Hordaland, Hordaland fylkeskommune og én informant fra hver av kommunene. Funnene gjort i undersøkelsene viser at kommunene ikke selv har klart å tilstrekkelig ivareta allmenn tilgjengelighet til strandsonen. Fylkesmannen fremmet innsigelse til begge områdereguleringene og ble dermed stående som forsvarer av allmenne interesser og allmenn tilgjengelighet i tettstedene. Dette gjaldt særlig i Våge, der områdereguleringen la opp til en fullstendig nedbygging og privatisering av strandsonen på Vågsneset. Innsigelsen førte frem til at “annen byggegrense” ble satt til 5 meter fra sjø av KMD. Undersøkelsene viser at begge områdereguleringene har klart å integrere strandsonen som en kvalitet der allmenn tilgjengelighet er sikret. Likevel viser funnene at tettstedene har et forbedringspotensiale som er sterkt knyttet til områdene som ikke er gjort allmenn tilgjengelig. Områdereguleringen for Storebø har i større grad enn Våge klart å utforme et tettsted som ivaretar allmenn tilgjengelighet. Dette har dog gått på bekostning av strandsonen ved at tettstedet trekkes ned mot sjøen, fremfor å ekspandere utenfor 100-metersbeltet. Funnene gjort i oppgaven viser at SPR strandsone er et velegnet verktøy i tettstedsplanlegging - såfremt retningslinjene blir tolket til sitt formål. Funnene viser derimot at kommunene vektlegger den delen som omhandler en lavere terskel for bygging i strandsonen, og tolker den til sin fordel. Undersøkelsene viser at dette har bidratt til at kommunene ikke tilstrekkelig har klart å ivareta allmenn tilgjengelighet til strandsonen i tettstedene. SPR strandsone fremstår med dette som en liberalisering av byggeforbudet. Det fremkommer også at fastsettelse av “annen byggegrense” bidrar til å “uthule” byggeforbudet, i den forstand at det ikke gis statlige eller regionale føringer for hvordan denne skal settes. Oppgavens resultater viser at allmenn tilgjengelighet til strandsonen ikke tilstrekkelig ble sikret i områdereguleringene for tettstedene Våge og Storebø, hovedsakelig fordi byggeforbudet og SPR strandsone åpner for tolkning. En tolkning som kan hindres ved tydeligere regionale og nasjonale føringer.nb_NO
