Nyttefordeling i jordskifteretten i saker etter jordskifteloven § 3-4

Abstract

Tema for oppgaven er hvordan nytte fordeles i jordskiftesaker i jordskifteretten, med avgrensning inn mot saker etter jordskifteloven § 3-4, ny utforming av eiendom eller alltidvarende bruksrett. Hovedproblemstillingen for oppgaven er dermed: Hvordan fordeles nytte i jordskifteretten i saker etter jordskifteloven § 3-4? Hovedproblemstillingen vil bli besvart gjennom tre delproblemstillinger: 1. Hvordan vurderer jordskiftedommere nytte og nyttefordeling? 2. Hvordan kommer vurderinger om nyttefordeling til uttrykk i sakens dokumenter? 3. Hvordan samsvarer fordelingen av sakskostnader med fordeling av nytte? For å svare på problemstillingene har det blitt gjennomført intervjuer med både dommere og parter i et utvalg av jordskiftesaker. Det har også blitt foretatt et dokumentstudie av rettsbøkene i de utvalgte sakene, og en kvantitativ undersøkelse av hvordan sakskostnader har blitt fordelt i et større utvalg av saker.

The theme of the project is how utilities are distributed in the land consultation court, with delimitation of cases concerning land consultation law section 3-4, modification to property and perpetual easement. The main research question is as follows: How are utilities from the land consultation court distributed in cases under section 3-4 of land consolidation law? The main problem will be answered by discussing three sub-problems: 1. How does the land consultation judges assess the utilities and utility distribution? 2. How does the assessment of benefits and utility distribution come across in the court records? 3. How does the allocation of legal costs correlate with the utility distribution? In order to answer the presented research questions, there have been held interviews with both judges and parties in a selection of land consultation cases. There have also been conducted documentary studies of the court records of the selected cases, and a quantitative survey of how legal costs have been allocated in a wider range of cases.
