Sammendrag
Temaet for masteroppgaven er EMK P1-1 og jordskifterettens oppfyllelse av protokollen i saker etter jordskifteloven §§ 3-4 og 3-8. Oppgaven tar for seg i hvilken grad jordskiftesaker etter §§ 3-4 og 3-8 løses i samsvar med EMK P1-1, og om jordskiftedommere har tilstrekkelig med kunnskap om protokollen til å ivareta dens eiendomsvern i behandlingen av jordskiftesaker.
Hovedproblemstilling:
I hvilken grad er jordskiftesaker etter jordskifteloven §§ 3-4 og 3-8 i samsvar med hvordan Den europeiske menneskerettsdomstolen håndhever EMK P1-1?
Underproblemstillinger:
• Behandles jordskiftesaker etter jordskifteloven §§ 3-4 og 3-8 i tråd med eiendomsvernet i EMK P1-1?
• Har jordskiftedommerne tilstrekkelig kompetanse om eiendomsvernet i EMK P1-1?
Oppgaven er en juridisk avhandling, hvor jordskiftesaker etter §§ 3-4 og 3-8 er analysert i lys av rettspraksis fra EMD som behandler saker etter EMK P1-1. For å belyse jordskiftedommeres kompetanse om eiendomsvernet i EMK P1-1 er det gjennomført en spørreundersøkelse, hvor jordskiftedommere er respondentene.
Jordskiftesaker etter jordskifteloven §§ 3-4 og 3-8 ser i stor grad ut til å behandles i tråd med eiendomsvernet i EMK P1-1, men det at jordskifteloven vurderer ulemper, kostnader og nytte etter en objektiv vurdering kan føre til brudd på protokollen. EMK P1-1 ser hen til subjektive hensyn, og særlig der disse hensynene er etiske vektlegges de i stor grad i proporsjonalitetsvurderingen.
Jordskiftedommere virker til å ha lite inngående kunnskap om eiendomsvernet i EMK P1-1, og det vil være hensiktsmessig med et høyere kunnskapsnivå når det gjelder protokollen – da denne ved motstrid går foran annen norsk lovgivning og også har et sterkere eiendomsvern enn jordskifteloven på visse punkter. The theme of this master thesis is ECHR P1-1 and the land consolidation court’s fulfillment of the protocol in cases concerning the land consolidation act §§ 3-4 and 3-8. The thesis examines to which degree land consolidation cases after §§ 3-4 and 3-8 are solved in compliance with ECHR P1-1, and whether or not the land consolidation judges has the necessary knowledge to assure the protocols protection of property.
The main research question is:
To which degree are land consolidation cases after the land consolidation act §§ 3-4 and 3-8 in compliance with how the European Court of Human Rights enforces ECHR P1-1?
Sub-questions:
• Are land consolidation cases treated after the land consolidation act §§ 3-4 and 3-8 in compliance with the protection of property after ECHR P1-1?
• Do land consolidation judges have the necessary knowledge concerning the protection of property after ECHR P1-1?
This assignment is a judicial thesis, where land consolidation cases after §§ 3-4 and 3-8 is analyzed in light of ECHR P1-1. A survey has been conducted to examine the land consolidation judges level of knowledge concerning the protocol – land consolidation judges were the respondents.
The protection of property after ECHR P1-1 seems to be fulfilled in most cases after the land consolidation act §§ 3-4 and 3-8, but the land consolidation act’s objective evaluation of disadvantages, costs and benefits may lead to a breach of the protocol. ECHR P1-1 also takes subjective considerations into account, especially when the considerations are ethical.
Land consolidation judges seems to have little in-depth knowledge about the protection of property after ECHR P1-1. A higher level of knowledge would be preferable as when in conflict, the protocol precedes other Norwegian legislation, and at some points has a stronger protection of property than the land consolidation act.
