dc.description.abstract | Kysten og strandzonen er i høj grad præget af modsatrettede interesser som første og fremmest
drejer sig om knaphed på areal. Dette giver sig udslag i en ”bit-for-bit” udbygning hvor det enkelte
tiltag ikke nødvendigvis har en negativ indvirkning, men det er summen af tiltag over tid som er en
trussel for strandzonens karakter og almene interesser. Opgaven undersøger hvordan man i praksis
har integreret statslige føringer for strandzonen i en regional plan for kystzonen og hvordan disse
føringer kommer til udtryk i kommuneplanens arealdel. De statslige føringer skal ses i lyset af ny
plan- og bygningslov (PBL) og statlige planretningslinjer for differensiert forvaltning av strandsonen
langs sjøen (SPR). Hensigten med at inkorporere statslige føringer i regional plan er for at lette og
ensrette forvaltningen af kystzonen på tværs af kommunegrænserne og opgaven behandler derfor
også hvordan de statslige føringer opfattes af myndighederne på regionalt og kommunalt niveau og
om processen har medvirket til en vertikal samordning.
Vestfold fylke og Nøtterøy kommune er valgt som case da området er beliggende langs Oslofjorden
hvor presset på strandzonen er størst og hvor SPR lægger de strengeste føringer for kommunernes
forvaltning. Indsamlingen af data er foregået via semistrukturerede interviews af informanter fra
fylkesmannen i Vestfold, Vestfold fylkeskommune og Nøtterøy kommune. Derudover er der blevet
udført et dokumentstudie af relevante lovværk, centrale plandokumenter og høringsudtalelser.
Hensigten med det reviderede byggeforbud jf. § 1-8 i PBL har været at indskærpe det råderum
kommunerne havde for at fravige bestemmelsen. Samtidig indførte man et undtag i form af ”anden
byggegrænse” som skulle sikre, at hvis kommunerne fraviger byggeforbuddet skal det være i form af
planer og ikke enkelttiltag. SPR tydeliggører byggeforbuddet ved at differentiere forvaltningen af 100
metersbæltet langs sjøen ud fra den erkendelse, at forholdene langs kysten ikke er ens.
Resultaterne viser at det kommunale handlingsrum opfattes som indskærpet efter revideringen, men
der ses en uoverensstemmelse i forholdet mellem byggeforbuddet, SPR og ”anden byggegrænse”.
Hvor kommunen opfatter ”anden byggegrænse” som en tydeligere ramme at planlægge indenfor, er
både fylkesmannen og fylkeskommunen af den opfattelse at ”anden byggegrænse” skubber
byggeforbuddet til side. Samtidig viser opgaven at man historisk i Vestfold har været underlagt en
restriktiv strandzoneforvaltning som betyder at SPR ikke har ændret praksissen hos kommunerne.
Integrationen af de statslige føringer i regional plan og vejleder viste sig at være omfattende, men
man fik det til i sidste ende. SPR er brugt i forhold til at fastsætte retningslinjer og bestemmelser i
forhold til bebyggelsens karakter i 100 metersbæltet og har lettet integreringen af byggegrænser.
Bagrunden er at SPR åbner op for en yderligere differentiering lokalt og denne mulighed har man i
stor grad benyttet sig af. Konkret er man nu gået bort fra opdelingen jf. de tidligere rikspolitiske
retningslinjer og har inddelt kystzonen i 4 zoner med tilknyttede retningslinjer. Generelt baserer
kommunen sin planlægning på den regionale plan med tilhørende vejleder. Det viste sig dog at man
ikke kunne enes om fastsættelse af byggegrænser men da man fik vejlederende løste konflikten sig.
Den regionale plan har derfor vist sig at legitimere gældende lovgivning og den manglende juridiske
virkning af planen har ikke medført at kommunen ser bort fra planen. Dette skyldes at kommunerne
tidligt blev inddraget i udarbejdelsen af planen og selv viste en interesse i at samordne
strandzoneforvaltningen. Planen viser at det kommunikative og instrumentelle planlægningsideal i
praksis kombineres, ved at kommunerne også selv havde et motiv for at deltage da byggeforbuddet
kun bortfalder hvis man indtegner byggegrænse.
Selvom udarbejdelsen af den regionale plan kan beskrives som en succes, viser undersøgelsen at
staten udviser en ambivalens når det kommer til byggeforbuddet. Dette kommer til udtryk i en
forskel i opfattelsen af ”anden byggegrænse” mellem myndighederne. Ambivalensen ses også i
forhold til SPR som i udgangspunktet skal tydeliggøre byggeforbuddet men i praksis i stor grad er
blevet er brugt til at fastsætte byggegrænser i 100 metersbæltet. | nb_NO |
dc.description.abstract | The coastal zone is greatly influenced by conflicting interests which first and foremost concerns the
scarcity of land. This can be translated into at piecemeal development where the individual initiatives
do not necessarily have a negative effect but it is the total numbers of activities over time which are
a threat to the very nature of the coastal zone and the interests of the general public. This thesis
examines how national guidelines for the coastal zone in practice are integrated in a regional master
plan and how they are expressed in the land-use element of the municipal master plan. The National
guideline are seen through the eyes of the new Planning and Building Act (PBL) and the National
Policy Guidelines for a Differentiated Management of the Shoreline along the Sea (SPR). The
intention of incorporating national guidelines in a regional masterplan is to facilitate and standardize
the management of the coastal zone across municipal borders. The thesis therefore also illustrates
how the national guidelines are perceived by the authorities at both the regional and municipal level
and if the process has contributed to a vertical coordination.
The county of Vestfold and Nøtterøy municipality has been chosen as a case study because the areal
is situated along the Oslo Fjord where the pressure on the coastal zone is highest and where SPR has
the strictest guidelines for the municipal management.
Data collection occurred through semi-structured interviews of informants from the office of the
County Govenor in Vestfold, the office of the County Authorities in Vestfold and Nøtterøy
municipality. In addition, there was carried out a study of relevant laws, planning document central
to the case and documents of the consultation process.
The purpose of the revised construction ban entailed by § 1-8 in PBL has been to impress upon the
scope in which the municipalities had been deviating from the stipulation. At the same time an
exeption was introduced in the form of "building limits" that would ensure that if the municipalities
deviate from the construction ban it must be in the form of planning and not through single
initiatives. SPR clarifies the construction ban by differentiating the management of 100-meter belt
along the shoreline realising that the conditions along the coast are not the same.
The results show that the municipal scope of action has been impressed upon by the revision, but we
see a discrepancy in the relationship between the building ban, "building limits" and SPR. Where the
municipality sees "building limits" as a clearer framework when planning within the framework, both
Fylkesmannen and fylkeskommunen believes that "building limits" pushes the building ban aside. At
the same time the thesis shows that historically Vesfold has been subjected to a restrictive coastal
zone management, which means that the SPR has not changed the practice of the municipalities. The integration of the national guidelines in the regional master plan turned out to be extensive, but
it was solved in the end. SPR was used in relation to establishing guidelines and regulations in
relation to the settlement's character in the 100-meter belt and has facilitated the integration of
building limits. The guidelines in SPR facilitate a further differentiation locally and this option has
largely been taken advantage of. Specifically, the authorities now have abandoned the division
entailed in the former National Policy Guidelines which means the coastal zone is now divided in 4
zones with associated guidelines. In general, the municipality has based its planning on the regional
master plan and used the guidelines to specify building limits in the coastal zone but as it turned out
in the process the municipality internally could not agree upon one solution. Eventually when the
regional master plan and the associated guide in how to specify construction boundaries was
completed the politicians accepted the solution and the conflict was resolved.
The regional master plan therefore has legitimized the current legislation and the lack of binding
legal effect of the regional master plan has not led to the municipality ignoring the plan. This is
because the municipalities in an early phase became involved in drafting the regional master plan
and showed an interest in standardizing the management of the coastal zone. The regional master
plan shows how both the idea of communicative and instrumental planning are combined in practice
which could be seen by the municipalities themselves having an interest in participating because the
constriction ban only lapses if “building limits” are drawn.
Even though the making of the regional master plan can be described as a success the thesis shows
the state exhibits an ambivalence when it comes to the building ban which is shown by the difference
in the perception of the "building limits" between the authorities in Vestfold. The ambivalence is also
seen in relation to the SPR when the intention of the guidelines is to clarify the construction ban but
in practice the guidelines to a large extent have been used to fix the building limits of the 100-meter
