Abstract
Denne oppgaven er en casestudie av Renovasjonsetaten i Oslo kommune og deres anbudskontrakt med Verieno AS. Formålet med casestudien er todelt. Det første formålet er å redegjøre for hvordan offentlig anbudskonkurranser gjennomføres i Norge. Det andre formålet er å trekke lærdom fra anbudskonkurransene gjennomført av Renovasjonsetaten i Oslo kommune i 2015 og den etterfølgende konkursen med anbudsvinneren Veireno AS i 2017.
Det har vært delte meninger om hvorvidt Oslo kommune skulle utføre renovasjonstjenesten internt i kommunen eller fortsette å utlyse tjenesten på anbud. Etter en vurderingsprosess valgte Oslo kommune å utlyse tjenesten for femte gang, og Veireno ble tildelt kontrakten. Det oppstod etterhvert flere komplikasjoner knyttet til kvaliteten og effektiviteten på leveransen, og det ble avdekket flere brudd på arbeidsmiljøloven. Da Renovasjonsetaten oppdaget dette så de ingen vei ut av kontrakten, da en heving av kontrakten mest sannsynlig ville medført store erstatningskrav ovenfor leverandør. Til slutt gikk Veireno konkurs, og det ble gjennomført en virksomhetsoverdragelse hvor Renovasjonsetaten selv tok over ansvaret for driften av tjenesten. This theis is a case study on Renovasjonsetaten in Oslo municipality and their tender agreement with Verieno AS. The purpose of the case study is divided in two. The first purpose is to explain how public tender competitions are conducted in Norway. The second purpose is to draw lessons from tender competitions conducted by Renovasjonsetaten in Oslo municipality in 2015 and the subsequent bankruptcy of the tender winner Veireno AS in 2017.
There have been conflicting opinions about whether Oslo municipality should carry out the renovation service internally in the municipality or continue to announce the service on tender. Following an assessment process, Oslo municipality chose to enlist the service for the fifth time, and Veireno was awarded the contract. There were eventually various complications related to the quality and efficiency of the delivery, and several breaches of the Working Environment Act were revealed. When the Renovasjonsetaten discovered this, they did not see any possible withdrawal from the contract, as a termination of the contract, most likely would have resulted in major compensation claims towards the supplier. In the end, Veireno went bankrupt and a business transfer was carried out, where Renovasjonsetaten itself took over operational responsibility for the service.
