dc.description.abstractEtter plan- og bygningsloven § 21-6 første ledd første punktum skal det i byggesaksbehandlingen ikke tas hensyn til privatrettslige forhold. Eiendomsutviklere kan da komme i en situasjon der de får godkjent en byggesøknad som er i strid med en negativ servitutt. Ekspropriasjon er et virkemiddel for å fjerne negative servitutter. Denne oppgaven tar for seg to hjemler for ekspropriasjon av negative servitutter: plan og bygningsloven § 16-2 første ledd og oreigningslova § 2 nr. 31 første alternativ. Det er kommunen som kan fatte ekspropriasjon etter plan og bygningsloven, og det er da bare til gjennomføring av vedtatt reguleringsplan jf. pbl. § 16-2 første ledd første punktum. Etter orl. § 2 nr. 31 første alternativ er det grunneieren som sender en søknad om ekspropriasjon til statsforvalteren. Hvordan forvaltningen håndterer disse sakene og hva de vektlegger er lite studert. På bakgrunn av dette har jeg utarbeidet følgende hovedproblemstilling: Hva er forvaltningens praksis ved ekspropriasjon av negative servitutter? For å besvare hovedproblemstillingen utarbeidet jeg fire underproblemstillinger: - Delproblemstilling A: Hvilke momenter blir vektlagt av forvaltningen i nødvendighetsvurderingen og interesseavveiningen ved ekspropriasjon av negative servitutter ved gjennomføring av reguleringsplan etter plan- og bygningsloven § 16-2 første ledd - Delproblemstilling B: Hvilke fordeler blir vektlagt av forvaltningen i interesseavveiningen ved behandling av søknader om ekspropriasjon av negative servitutter etter oreigningslova § 2 nr. 31 første alternativ - Delproblemstilling C: Hva er forvaltningens praksis knyttet til forhåndsvarsling ved ekspropriasjon av strøksservitutter? - Delproblemstilling D: Hvilke momenter blir vektlagt av forvaltningen ved avgjørelse om forhåndstiltredelse, og hva er den gjennomsnittlige saksbehandlingstiden? Oppgaven viser at forvaltningen i nødvendighetsvurderingen ved ekspropriasjon etter pbl. § 16-2 legger vekt på at ekspropriasjon er nødvendig når negative servitutter er til hinder for gjennomføring av reguleringsplan. Oppgaven viser også at det er en rekke momenter som blir vektlagt i interesseavveiningen av forvaltningen i ekspropriasjonssaker etter pbl. § 16-2 første ledd og orl. § 2 nr. 31 første alternativ. Oppgaven viser at forvaltningen i forhold til forhåndsvarsling, varslet direkte til rettighetshaverne i saker etter orl. § 2, og at det i hovedsak var søker som hadde ansvar for dette. I saker etter pbl. § 16-2 ga kommunen forhåndsvarsel direkte samt varslet ved offentlig kunngjøring. Ved forhåndstiltredelse er det mange ulike momenter som vektlegges, og at disse varierer etter sakstype. Den gjennomsnittlige saksbehandlingstiden var 146 dager hos statsforvalteren og 72 dager hos departementet.en_US
dc.description.abstractAccording to The Planning and building Act § 21-6 first paragraph first sentence, in the processing of building applications private legal affairs shall not be taken into consideration. Real estate delevelopers can then come in a situation where they get approved a construction application that is in direct conflict with a negative easement. Expropriation is a tool to remove negative easements. In this thesis i look at two legal basises for expropriation of negative easements: The Planning and building Act § 16-2 first paragraph first sentence and The Expropriation of Real Property Act § 2 nr. 31 first alternative. It is only the municipality that can approve a decition of expropriation after The Planning and building Act § 16-2 first paragraph first sentence, and there can only be expropriatet to implement an approved zoning plan. After The Expropriation of Real Property Act. § 2 nr. 31 first alternative it is the landowner that send the aplication of expropriation to the county governor. How the public authorities handle these cases and what is epmphasized is little studied. On this basis i have developed the following main research question: what is the public authorities practice in regard to expropriation of negative easements? To answer the main research question i have developed the following four research questions: - Research question A: Wich moments is emphasized by the public authorities in the necessityassessment and the interestweighing by expropriation of negative easements by implementing of zoning plans after the Planning and building Act § 16-2 first paragraph first sentence? - Research question B: Wich advantages is emphasized by the public authorities in the interestweighing in the processing of applications of expropriation of negatie easements after The Expropriation of Real Property Act. § 2 nr. 31 first alternative? - Research question C: What is the public authorities practice in regard to advance notice by expropriation of negative covenants? - Research question D: Wich moments is emphasized by the public authorities in regard to the desicion of advance notice, and what is the average processing time? The assignment shows that the public authorities in the necessityassessment, by expropriation after the planning and building act § 16-2, emphasizes that expropriation is necessary when negative easements is preventing implementing of a zoning plan. The assignment also shows that there is a wide range of moments that is emphasized by the public authorities in cases of expropriation after The Planning and building Act.§ 16-2 first paragraph first sentence and The Expropriation of Real Property Act. § 2 nr. 31 first alternative. The assignment shows that the public authorities in regard to advance notice, gave advance notice directly to the rights holders in cases after the Expropriation of Real Property Act § 2, and that in most cases it was the applicant that was in charge of this In cases after the planning and building act § 16-2, the municipality gave advance notice directly and by public anouncement. By advance accesion there it a wide variety of moments that is emphasized, and these vary after case type. The average procesing time was 146 days for the county governor and 72 days for the ministry.en_US
