dc.description.abstractTemaet for oppgaven er Sivilombudsmannens rolle som kontrollorgan i saker etter plan- og bygningsloven, med avgrensning mot saker om dispensasjon fra arealplaner. Hovedproblemstillingen som oppgaven stiller søker å belyse de ulike stadiene av ombudsmannens klagebehandling, samt hvordan forvaltningen følger opp hans uttalelser. For å besvare hovedproblemstillingen har det blitt utarbeidet fire delproblemstillinger: 1. Hvordan vurderer ombudsmannen om en klagesak sak skal tas opp til nærmere behandling? 2. I hvilken grad vektlegger Sivilombudsmannen det kommunale selvstyret gjennom sin overprøving av forvaltningens dispensasjonsvedtak? 3. Hvilke momenter danner grunnlaget for Sivilombudsmannens kritikk av forvaltningen i dispensasjonssaker? 4. Hvordan blir Sivilombudsmannens uttalelser vurdert av forvaltningen, og i hvilken grad blir de tatt til følge? Det teoretiske grunnlaget bygger hovedsakelig på Sivilombudsmannens egne dokumenter, faglitteratur, lovverket og lovforarbeider. Det empiriske grunnlaget er basert på en dokumentstudie av saker hvor Sivilombudsmannen har uttalt seg om dispensasjon fra arealplaner. Studien består av totalt 17 uttalelser, hvorav tre uttalelser har blitt undersøkt nærmere. I tillegg har jeg intervjuet en av Sivilombudsmannens ansatte som arbeider med plan- og byggesaker for å få nærmere innsikt i ombudsmannens erfaringer og synspunkter. Funnene i avhandlingen viser at ombudsmannen utfører konkrete vurderinger i hver enkelt sak før det blir avgjort om de skal realitetsbehandles. Dette innebærer at flertallet av sakene får en form for overprøving, uavhengig av om de ender med en formell uttalelse eller ikke. I vurderingen av klagesakene har jeg kommet frem til at ombudsmannen er varsom med å overprøve forvaltningens frie skjønn, og det kommunale selvstyret blir følgende sjelden vektlagt i dispensasjonssaker. Videre har jeg kommet frem til at momentene som danner grunnlaget for ombudsmannens kritikk av forvaltningen i stor grad vurderes ut ifra forholdene i den enkelte sak, men vurderingen av dispensasjonsvilkårene i pbl § 19-2 er et sentralt moment for samtlige av uttalelsene. Avslutningsvis kom jeg frem til at forvaltningen i all hovedsak tar Sivilombudsmannens uttalelser til følge.  nb_NO
dc.description.abstractThe topic of this master thesis encompasses the Parliamentary Ombudsman’s role as controlling authority in cases under the Planning and Building act. This thesis focusses on cases concerning dispensations from plans for land use. Through exhaustive investigation, research presented below answers how the Parliamentary Ombudsman processes these cases and to what extent the Public Administration follow his statements. The answers will be produced through discussing four sub-questions: 1. How does the Parliamentary Ombudsman decide which cases to process? 2. To what extent does the Parliamentary Ombudsman focus on the local democracy in the control of the Public Administration? 3. Which elements makes the foundation of the Parliamentary Ombudsman’s criticism of the Public Administration? 4. How does the Public Administration consider the Parliamentary Ombudsman’s statements, and to what extent do they follow his statements? The research utilises document studies of legislation, annual reports, case documents and literature about the Parliamentary Ombudsman. Thorough research of 17 case documents regarding dispensation from plans for land use lead me to further investigation through an interview with one of the Parliamentary Ombudsman’s employees about this topic. I have found that the Parliamentary Ombudsman makes systematic evaluations for each case before he decides which cases to process further. It was also discovered that the Ombudsman is reticent about processing the Public Administration’s discretion. Furthermore, this thesis indicates that the Ombudsman’s criticism of the Public Administration varies between each case, depending on the conditions in each case. It also indicates that the review about the terms in § 19-2 in the Planning and Building act is a central element of the criticism in all 17 cases. Moreover, the thesis indicates that the Public Administration mainly follows the Parliamentary Ombudsman’s statements.nb_NO
