dc.description.abstractDeling av landbrukseiendommer med formål om salg av tilleggsjord til aktiv driver er ønskelig fra bredt politisk hold med bakgrunn i intensjonen om at aktive bønder skal eie arealet som drives fremfor å leie det inn. En betydelig del av landbrukseiendommene er imidlertid odelseiendommer med påhvilende odelsrett. Odelsrettshavere kan potensielt gjøre odelsretten gjeldende overfor erververen. Masteroppgaven tar for seg hvordan odelsretten innvirker på fradeling og salg av tilleggsjord fra odelseiendom. Dette undersøkes ut fra to underproblemstillinger: hvordan grunneiere håndterer odelsretten i den sammenheng, samt i hvilken grad odelsrett tas i betraktning i delingsbehandlingen. Det empiriske grunnlaget for belysning av problemstillingen er innhentet gjennom kvalitative intervjuer med tre grunneiere og tre landbruksforvaltninger innenfor undersøkelsesområdet Follo og Indre Østfold. Empirien danner også grunnlaget for flere juridiske drøftinger innen problemstillingens rammer. På den bakgrunn utgjør også juridisk metode en sentral del av masteroppgavens metode.nb_NO
dc.description.abstractDivision of agricultural properties with the purpose of selling the farmland to active farmers is desirable from a broad political view based on the wish that active farmers should own the agricultural land rather than renting it. However, a significant share of the agricultural properties have allodial right attached. Licensees can potentially reclaim the property from the new owner. The master's thesis looks into how the allodial right affects division and sale of parts from agricultural properties with allodial rights attached. This is investigated on the basis of two sub-problems: how landowners handle the allodial rights in that context, and to what extent allodial rights are taken into consideration when the agricultural administrations process the cases concerning division of the agricultural property. The empirical basis for elucidating the question has been obtained through qualitative interviews with three landowners and three agricultural administrations within the research area, Follo and Indre Østfold. The findings also form the basis for several juridical discussions within the framework of the thesis. On this background, Legal Method also represents a central part of the used method in the master’s thesis.nb_NO
