dc.description.abstractDagens plan- og bygningslov skal legge til rette for en styring av dagens samfunnsutvikling, hvor flere interesser og hensyn må ivaretas. Deriblant har det gjennom utvikling av plan- og bygningsloven kommet revideringer hvor kravet om medvirkning kommer sterkere frem. Det jeg har undersøkt i denne masteroppgaven er hvordan bestemmelser om medvirkning i planprosesser påvirker et utviklingsprosjekt. I den anledning har jeg undersøkt tre detaljreguleringer fremmet av private aktører i Fredrikstad kommune. Planene er tilnærmet like etter formål og omfang, samt vedtatt etter Plan- og bygningsloven av 2008. Underveis har jeg valgt å undersøke tre hypoteser i forbindelse med hovedproblemstillingen. Hypotesene har dreiet seg om utviklers handlingsrom, effektiviteten i en planprosess og uenigheter etter vedtatt plan. Etter å ha foretatt en kvalitativ empirisk undersøkelse, har jeg fått inn data som indikerer at medvirkning i planprosessen kan ha store konsekvenser for en utbygger. Underveis i forskningen kom det frem at ved to av planene jeg har valgt å undersøke har det blitt nedlagt et bygge- og deleforbud. Dette har ført til at selve utviklingen av eiendommen har stoppet opp for to av eiendomsutviklerne. Det avventes fremdeles i dag svar fra en annen instans før prosjektene kan fortsette.nb_NO
dc.description.abstractToday's Planning and Building Act shall facilitate the management of today's societal development, where more interests and considerations must be taken care of. In addition, through the development of the Planning and Building Act, revisions have been made where the requirement for participation is more pronounced. What I have studied in this Master's thesis is how rules on involvement in planning processes affect a development project. For this reason, I have examined three detailed regulations promoted by private actors in the municipality of Fredrikstad. The plans are approximately according to the purpose and extent, as well as adopted in accordance with the Planning and Building Act of 2008. Along the way I have chosen to examine three hypotheses in connection with the main problem. The hypotheses have focused on developers' action rooms, the effectiveness of a planning process and disagreements according to the adopted plan. After conducting a qualitative empirical survey, I have received data indicating that involvement in the planning process can have major consequences for a developer. Along with research, it emerged that two of the plans I have chosen to investigate have been subject to a building and parts ban. This has meant that the actual development of the property has stopped for two of the property developers. It is still awaiting response from another agency before the projects can continue.nb_NO
