dc.description.abstractTemaet for oppgaven er hvordan de nye lovbestemmelsene for rettens sammensetning ved anke i jordskifteloven § 8-7 og domstolloven § 12 andre ledd blir praktisert ved de ulike lagmannsretter. Det undersøkes hvordan sammensetningen av retten ved behandling av anker har blitt i praksis, og hvilke erfaringer man ved lagmannsrettene har gjort i løpet av det første drøye året jordskifteloven har vært i kraft. Følgende problemstillinger søkes belyst: 1. Hvilke vurderinger legges til grunn når sammensetning av lagmannsretten bestemmes? 2. Anvendes lovbestemmelsene forskjellig i de ulike lagdømmene? 3. Har lovendringen bedret partenes rettssikkerhet i henhold til lovgivers intensjoner? Oppgaven er avgrenset til å omfatte rettsmiddelet anke, og nærmere bestemt sammensetningen av retten i ankeinstansen. Det er undersøkt anker over følgende typer avgjørelsesformer: - anke over jordskifteavgjørelse - anke over dom - anke over kjennelse - anke over skjønn (overskjønn) - anke over dom og kjennelse fra tingretten Når denne oppgaven skrives har jordskifteloven av 21. juni 2013 vært i kraft i litt over ett år. Jordskifteoverrettene er fusjonert med lagmannsrettene, og lagmannsrettene har fått tilført jordskiftefaglig kompetanse i form av jordskiftelagdommere. Funnene viser at denne tiden har vært preget av at det har tatt tid å få tilsatt jordskiftelagdommere i samtlige lagmannsretter. Dette har fått direkte innvirkning på anvendelsen av de nye lovbestemmelsene den første tiden etter at jordskifteloven trådte i kraft, ved at ikke alle lagmannsretter har hatt mulighet til å ta i bruk alle de alternativer for rettens sammensetning som loven åpner for. Alle lagmannsrettene legger hovedsakelig vekt på de samme hensyn ved beslutninger om rettens sammensetning: hvilken kompetanse som kreves for å få en best mulig prøving av de spørsmål saken reiser, og den samlede ressurssituasjonen med tilgjengelige dommere ved den enkelte domstol. Dersom de to hensynene tilsier forskjellige valg av sammensetning, tillegges det sistnevnte større vekt. Det er i all hovedsak lovens hovedregler om rettens sammensetning for de ulike avgjørelsesformene som brukes. Funnene indikerer likevel mot at det er enkelte forskjeller mellom lagmannsrettene. Lovgiver hadde intensjoner om å skape en enklere og bedre ankeordning for partene i saker anket fra jordskifteretten. Samtidig vektla de å sikre kvalitet ved saksbehandling og en smidig administrasjon av lagmannsrettene. Funnene viser at dette i all hovedsak er oppnådd.nb_NO
dc.description.abstractThis thesis is a survey of how the new provisions concerning the composition of the panels of the Courts of Appeal in Section 8-7 of the Land Consolidation Act and Section 12 second paragraph of the Courts of Justice Act have been applied by the different Courts of Appeal a little over one year after the new Land Consolidation Act entered into force. The survey looks into the composition of the panels of the Courts of Appeal when hearing appeals in land consolidation cases, cases concerning boundaries and rights in real property, and cases concerning appraisals of the value of real property for the purpose of determining the compensation owed to the owner upon its expropriation). When The Land Consolidation Act of 21 June 2013 entered into force, the previous Land Consolidation Courts of Appeal were merged with the ordinary Courts of Appeal. Land consolidation court of appeal judges have been appointed and serve in the Courts of Appeal to ensure proper competency when appeals against land consolidation decisions are heard and decided. The main findings show that the application of the new provisions during the first year under the new Land Consolidation Act has been impacted by the fact that it has taken some time to appoint land consolidation court of appeal judges for some of the country's six Courts of Appeal. Not all of the Courts of Appeal have been able to apply the full range of alternative compositions of the panels of the Court of Appeal that are available under the new act. The survey shows that two main considerations are predominant when the Courts of Appeal decide on the composition of the panel that is to hear an appeal: firstly which composition will ensure the best possible review of the individual case, taking into account the competence and experience best suited in the light of the characteristics of the case, and secondly the general workload and availability of judges of the individual Court of Appeals. Should there be conflict between the two, the latter will be given preference. The findings show that the Courts of Appeal tend to choose the standard or "default" composition rather than one of the alternative compositions. Still, certain differences between some of the Courts of Appeal are recorded. The legislators intended to create, in the interest of the parties, a simpler procedure for appeals against decisions of the Land Consolidation Courts, implementing procedural rules of a high quality, as well as an efficient administration of the Courts of Appeal. The findings show that this has been generally achieved, more or less as intended.nb_NO
