dc.description.abstract | Temaet for avhandlingen er eiendomsdannelse i bytransformasjon. Eiendomsdannelse går i denne sammenheng ut på å omforme eksisterende eiendomsforhold og etablere nye som gir sikkerhet for de nye "formelle" eier-, eiendoms- og rettighetsstrukturene et byggeprosjekt forutsetter at produseres. Både utbyggere, sluttbrukere og andre rettighetshavere har behov for at det etableres sikkerhet omkring den nye eiendomssituasjonen via innføring i offentlige objektregistre (matrikkelen) og registrering i rettighetsregistreret (grunnboken). Disse transaksjonene danner grunnlag for effektiv omsetning, finansiering samt en rekke disposisjoner over fast eiendom. Eiendomsdannelse er dermed en praktisk og formell forutsetning for gjennomføring av by-/eiendomsutviklingsprosjekt til bolig- og næringsformål. dc.description.abstract | The thesis focuses on transformation of land tenure structures during planning and implementation of urban redevelopments and analyzes from an institutional perspective property formation processes in relation to transactions and transaction costs. Urban redevelopments face fragmented and complex land tenure structures, both property-, ownership and rights structures registered in the cadastre and land book records, and unregistered contractual structures confined within the private sphere. Planning and implementation of such projects also meet public regulations through planning- and development control. The research questions deals with how the institutional framework concerning property formation and planning and implementation of urban redevelopment projects affect transactions that are necessary to complete property formation, and how the design of these (formal and informal} institutions affect transaction costs. These questions relate to how institutional design affects the efficiency of property formation processes in the context of urban redevelopment. The research questions are mainly analyzed from a user- and over all "system" perspective. The analytical model identifies theoretically generalizable phases relating to property formation that are embedded in formal institutions during land assembly, plan- and development control and implementation of urban redevelopments. The model is based on institutional and transaction cost theory applied to land development and focuses on how institutions create user rights regimes and how these affect efficiency in transformation of land tenure structures in urban redevelopments. | nb_NO |
