Kan det sies at bestemmelsene om boplikt har utspilt sin rolle?

Abstract

Temaet for denne oppgaven er boplikt og hensynene bak boplikten. Jeg tar for meg spørsmålet om de rettslige bestemmelsene om boplikt har utspilt sin rolle, eller om bestemmelsene fremdeles ivaretar viktige samfunnsmessige hensyn. Et av hovedhensynene som ligger til grunn for boplikten, er hensynet til bosetting. Jeg har i denne oppgaven sett nærmere på Hallingdalsregion for å finne ut hvordan bestemmelsene om boplikt påvirker bosettingen der, og hvilke konsekvenser en eventuell fjerning av disse bestemmelsene vil kunne føre til. Jeg har gjennomført intervjuer med representanter fra Hallingdalkommunene; Flå, Nes, Gol, Hemsedal, Ål og Hol. I tillegg til dette har jeg også intervjuet en representant i Landbruksdirektoratet og en representant fra Landbruks- og matdepartementet.

Problemstillingene mine, lyder som følger.

Hovedproblemstilling: - Kan det sies at bestemmelsene om boplikt har utspilt sin rolle?

Med følgene underproblemstillinger: -Hvorfor ble boplikten innført i Norge? -Hvordan fungerer boplikten? -Hva vil kunne skje om boplikten fjernes? -Hvilke verktøy kan kommunen ta i bruk dersom boplikten fjernes?

Det jeg har funnet ut i arbeidet med denne oppgaven er at boplikten har en betydning for bosettingen i Hallingdal. Etter alle intervjuene med de forskjellige representantene sitter jeg igjen med klart bilde av at de mener bestemmelsene om boplikt er helt vesentlig for å ivareta hensynet til bosetting.

The theme of this thesis is the residence requirements in Norway, and the considerations behind these requirements. I have through working with this thesis studied the Hallingdal region to find out how the residence requirements impact the population growth there, and the consequences of a possible removal of these requirements. I have done this by studying the law, and interviewed several representatives from each of the municipalities in Hallingdal. In addition to this I have also interviewed a representative from the Directorate of Agriculture and a representative from the Ministry of Agriculture.

The main research question is: -Can it be said that the residence requirements no longer are useful?

I have also formulated three sub-questions: -Why were the residence requirements introduced in Norway? -How do the residence requirements work? -What could happen if the residence requirements were removed? -What other tools can the municipalities use if the residence requirement were removed?

What I’ve found out through working with this thesis is that the residence requirements definitely have an impact on the population growth in the Hallingdal region, and my conclusion is that it’s crucial that the residence requirements are preserved in countryside’s like Hallingdal.
