Sammendrag
Temaet for denne masteroppgaven er hvordan jordskifteretten behandler innpåkjøp i privat veg ved ny jordskiftelov av 21. juni 2013. Formålet er å se på hvilke muligheter jordskifteretten har til å behandle innpåkjøp i privat veg. Ved lov av 21. juni 2013 nr. 100 om fastsetjing og endring av eigedoms- og rettshøve på fast eigedom (jordskiftelova) har jordskifteretten fått eksklusiv hjemmel til å behandle innpåkjøp etter lov av 21. juni 1963 nr. 23 om vegar (veglova) kapittel VII. Tidligere hadde jordskifteretten hjemmel etter lov av 21. desember 1979 nr. 77 om jordskifte (jordskifteloven) § 2 første ledd bokstav e, som er videreført i ny jordskiftelov § 3-9 om felles tiltak og investeringer. Jeg ønsker med denne masteroppgaven å belyse hvilke hjemmel/hjemler jordskifteretten har til å behandle innpåkjøp etter dagens lov. Hovedproblemstillingen i oppgaven er: ”Hvordan skal jordskifteretten behandle skjønn etter vegloven § 53? For å konkretisere hovedproblemstillingen har jeg tatt inn to delproblemstillinger: 1. Hvordan skal kostnadene ved innpåkjøp fordeles? 2. Er det anledning til å kreve innpåkjøp etter jordskifteloven kapittel 3? The theme of this thesis is how the land consolidation court treats claims concerning the
establishment of the use and administration of a private road discretion by the new Land
Consolidation Act (jordskiftelov) of June 21, 2013.
The purpose of this master is to look at what opportunities the land consolidation court has to
treat establishment of rights to use and manage private roads. By The Land Consolidation Act
(Jordskifteloven) of 2016 has land consolidation court had exclusive authority to manage this by
the Public and Private Roads Act (Vegloven) Chapter VII. Previously, the land consolidation
court pursuant to treat this by Land Consolidation Act of 1979 § 2 subsection e, which is
continued in the new law § 3-9 on joint initiatives and investments. Thus, this paper attempts to
shed light on the source or authorizes land consolidation court by current law has to
treat establishment of rights to use and manage private roads.
The main issue in the study has been: "How should land consolidation court probate process
discretion by the Public and Private Roads Act § 53?” To concretize the main question, I have
included two more issues:
1. How should costs by establish rights to use and manage the private road be
allocated?
2. Is it allowed to demand that the land consolidation court fixed for right to use and
administers a private road by the Land Consolidation Act chapter 3?
