dc.description.abstractLandarealer er begrensede ressurser, og det oppstår ofte konflikter mellom ulike interesser om bruken av dem, for eksempel mellom utbygging og vern. Plan- og bygningsloven er vårt viktigste verktøy for å forvalte arealene og legge til rette for ulike samfunnsinteresser. Gjennom konsekvensutredninger sikrer man at hensyn til natur, miljø og samfunn blir ivaretatt ved planleggingen i utbyggingssaker. Naturmangfoldloven er også en viktig lov ettersom den inneholder prinsipper som skal legges til grunn når det offentlige fatter beslutninger. Oppgavens problemstilling har vært å undersøke hvordan hensyn til natur og miljø ble ivaretatt i planleggingen av ny E18 gjennom Ås og Ski i Akershus, og av Follobanen fra Ski til Oslo, samt bruk og betydning av naturmangfoldlovens kapittel II i planleggingen. Metoden som ble brukt var en kvalitativ casestudie, bestående av intervjuer kombinert med dokumentstudier. Resultatene viser at for E18 var landbruk og kulturminner de tyngste interessene, og de ble avgjørende for valg av veitrasé. Verdier knyttet til naturmiljøet, friluftslivet og landskapet i området var ikke like store. Også for Follobanen var kulturminner og landbruk interesser som veide tungt, men ettersom jernbanen hovedsakelig skal gå i tunnel medførte ikke utbyggingen like store påvirkninger på natur og miljø som motorveien. Ved intervjuene kom det frem at alle informantene mente at hensynet til natur og miljø ble godt ivaretatt og likestilt med andre samfunnsinteresser, som for eksempel økonomi. Resultatene viser i tillegg at bruken og betydningen av naturmangfoldlovens kapittel II ikke var like stor som forventet. Konklusjonen er at natur og miljø ble godt ivaretatt i begge sakene, og de ble i stor grad likestilt med andre interesser. Den konkrete bruken av prinsippene i naturmangfoldlovens kapittel II kunne derimot ha vært bedre. Min oppfatning er at loven likevel har fått betydning for utbyggingssaker ved at den har bidratt til økt fokus på at natur- og miljøhensyn må inngå som et viktig premiss i all planlegging. Land areas are limited resources, and conflicts often occur between different interests on the use of them, such as development versus conservation. The Planning and Building Act is our main tool for managing areas and facilitates various social interests. Through impact assessments it is ensured that the regard for nature, the environment and society are taken into account during the planning of development projects. The Nature Conservation Act is another important law because it contains principles to be applied when the public authorities make decisions. The chosen topic for this master thesis was to examine how the regard for nature and the environment were taken into account in the planning of the new E18 freeway through Ås and Ski and the Follo Line railway from Ski to Oslo, and the use and importance of chapter II in the Nature Conservation Act. The method used was a qualitative case study, with interviews combined with document studies. The results showed that in the E18 case, agriculture and cultural heritage were the heaviest interests, and were decisive for the choice of corridor. The values associated with the natural environment, outdoor recreation and landscape of the area were not as large. In the Follo Line case, agriculture and cultural heritage were weighted heavily, but due to the fact that the railroad will mainly go in a tunnel, the project did not influence the environment as much as the freeway. All interviewees believed that the regard for nature and the environment were well taken care of and equal to other public interests such as economics. The results showed that the use and importance of the Nature Conservation Act chapter II was not as great as expected. The conclusion is that nature and the environment were well taken care of in both cases, and were largely weighted equally with other interests. However, the specific use of the principles in the Nature Conservation Act chapter II could have been better. My opinion is that the law has gained importance for development projects, in that it has contributed to an increased focus on the regard for nature and the environment, and has become a critical consideration in all planning.no_NO
