dc.description.abstractNorge er et land med økende befolkningsvekst. Spesielt er det kystnære østlandsområdet presset i forbindelse med arealbruk, mye av årsaken kommer av beliggenhet med en attraktiv kyststripe. Flere mennesker betyr mer arealbruk og mer arealbruk betyr et større behov for en god planlegging av arealene. For å kunne oppnå en bærekraftig bruk av arealene er arbeidet med planlegging og utviklingen av hensiktmessige løsninger en viktig politisk oppgave både på nasjonalt-, fylkes- og kommunenivå. Et av målene fra stortinget er å samordne arealplanleggingen på regionalt og lokalt nivå, slik at den fremmer en ønsket arealbruk og dermed en ønsket samfunnsutvikling i landet. Staten utarbeider lovverket og retningslinjene. Bestemmelsene blir videreført til den regionale og kommunale planleggingen. I denne studien er det sett på hvordan naturmiljøet blir ivaretatt i forhold til planarbeidene regionalt og lokalt i fylket Vestfold. Det er gjort en intervjustudie av to utvalgte kommuner i fylket for å se nærmere på kommunenes praksis. Vestfold er et fylke med press på arealene fra ulike interesser, spesielt andelen jordbruk og kulturminner spiller inn i planlegging og utviklingsprosesser. I dette studie er representanter fra to utvalgte kommuner innen fylke blitt intervjuet slik at jeg kunne få et innblikk i praksisen av arealforvaltning lokalt, spesielt med tanke på naturmiljøet. Begge kommunene gir uttrykk for at lovverket følges og som forventet for Vestfoldregionen er det landbruket, kulturminner og kystområdene som skaper utfordringer lokalt. Det er to funn som skiller seg ut som forskjeller i de undersøkte kommunene. Dette er lokalpolitikernes og arealplanleggernes betydning for hvordan naturmiljøet blir ivaretatt, og planleggerne i kommunens tolkning av lovverket med tanke på skjønn. Det som påvirker hvordan en kommune ivaretar naturmiljøet mest er skjønnet hos planleggeren. Det viser seg gjeldene at det er en forskjell i forståelsen av lovverket hos kommunene. Dette kan grunne i manglende praksis og erfaringer med den relativt nye naturmangfoldloven. Naturmangfoldloven er den viktigste loven vi har med tanke på ivaretakelse av naturmangfoldet. Denne studien viser at naturmiljøet i seg selv blir ivaretatt etter intensjonene i lovverkene, da først og fremst plan og bygningsloven og naturmangfoldloven. For at dette skal fungere er det viktig med en god planlegging og et godt lovverk, samt god kunnskap og forståelse fra de som utøver planleggingen av samfunnet slik at man kan få til best mulige løsninger for alle. Norway is a country with increasing population growth. In particular the eastern area by the cost is pressured regarding land use and the biggest reason is the attractive location with a coastline. More people mean more use of land, and more use of land means a greater need for good planning of these areas. In order to achieve a sustainable use of the areas, planning and development of appropriate solutions are an important political task on all levels, national, regional, and local. One of the Parliament goals is to coordinate the planning of the areas between the regional and local levels so that it will promote a desired use of area and by that a desired social development in the country. The government prepares legislation and guidelines. These provisions and guidelines are used in the regional and municipal planning of the areas. In this study we have examined how the environment is protected by the planning regionally and locally in the county of Vestfold. By using interview studies of two selected municipalities in the county, I have looked into the municipal practices. Vestfold is a county with a lot of pressure on its areas from a various interest, particularly the proportion of rural and cultural heritage plays into the planning and development processes. In this study I have interviewed representatives from two selected municipalities in the county of Vestfold to get an insight on how area management is practiced, especially regarding the environment. Both municipalities have stated that laws are followed, and as expected agriculture, cultural heritage, and coastal areas pose challenges locally in Vestfold. There are two findings that stand out as differences in the chosen municipalities. It is the local politicians and the area planners in the municipalities that impact how the environment is safeguarded. It is also the area planners in the municipalities interpretation of the legislation in terms of judgment. What effects how a municipality maintains the natural environment is mostly judgment of the area planners. It shows that there is a difference in interpretation of the legislation in between the municipalities. This may be because of a lack of practice and experience with the relatively new biodiversity law. Naturmangfoldloven is the main law we have in terms of safeguarding biodiversity. This study shows that the natural environments are protected by the legislation, first and foremost Plan og bygningsloven and Naturmangfoldloven. For the legislation to be most functional it is important to have good planning and good laws, as well as knowledge and understanding from those who practice area planning in the municipality to obtain the best possible solutions for everyone.no_NO
