Agreement for electronic publication of material via Brage at UMB (UMB Open Research Archive)

1 Permission to publish electronic material 
1.1 The author hereby grants UMB a free, non-exclusive right to make the submitted electronic material, hereinafter called the material, available in electronic form via Brage, which means publishing it on the internet.
1.2 The author is aware of, understands and accepts the consequences of publication via the internet. Among other things, such publication means that other websites can include links to the material. If the author plans to publish the material through a publishing company or in a journal, the author should be aware that this could have consequences when the material is also made available in Brage. See clause 3.3. 
2 UMB’s obligations/responsibility 

2.1 UMB shall make the material available in the form in which it was submitted to UMB, with text, tables, graphics, images, multimedia content etc., but with such technical adaptations as are deemed necessary for publication on the internet. 
2.2 UMB shall endeavour to protect the material from being changed by unauthorised persons/third parties insofar as this is possible given the technical solutions we use. 
2.3 UMB shall not have any rights to the material over and above the rights explicitly set out in this agreement. 
2.4 UMB is not in any way responsible for the content of material published via Brage or for any other behaviour/actions of the author. UMB shall not be liable for any damage or loss that arises in connection with this agreement, unless the damage or loss was caused wilfully or by gross negligence on the part of UMB or a party for which UMB is responsible. This liability shall under no circumstances cover indirect damage or losses. 

3 The author’s obligations/responsibility 
3.1 The author shall comply with UMB’s guidelines for publication in Brage.
3.2 When entering into agreements with journals, publishing companies etc. for making available material covered by this agreement, the author shall endeavour to safeguard UMB’s rights pursuant to the present agreement as far as possible. 
3.3 The author must clarify the consequences of publishing material in Brage in relation to publishing companies, journals or other copyright holders. 

The author guarantees that he/she is the author of the submitted material and has complete freedom to dispose of it in its entirety. If any other parties have rights that rule out publishing in electronic form via Brage without the permission of a third party, the author must obtain the necessary consent. 
If the material has more than one author, the author who has submitted the material guarantees that he/she has obtained the necessary consent from the other authors. 
If the material or parts thereof has previously been published in a journal or by a publishing company, or if there are plans to publish the materials or parts thereof in a journal or through a publishing company, the author guarantees that he/she has obtained the necessary consent from the journal/publishing company. 
If the document or parts thereof contains photographs, drawings or other copyright material, the author guarantees that he/she has obtained the necessary consent from third parties in advance.
UMB recommends the author to obtain written consent from co-authors, journals, publishing companies or third parties, and that these consents be filed so that they can be presented if required. 
3.4 The author guarantees that the material neither contains material that can be deemed to be in violation of applicable Norwegian law, nor contains links to any such material.
3.5 If UMB should become liable in damages in relation to a third party because the author has not fulfilled his/her obligations pursuant to this agreement, the author shall indemnify UMB. 
4 Transfer and termination of the agreement 
4.1 UMB can only transfer its rights and/or obligations pursuant to this agreement to a third party on the condition that the author’s interests pursuant to this agreement are safeguarded in the transfer agreement. 
4.2 UMB has an unlimited right to suspend the availability of the document if there are reasonable grounds for so doing.
4.3 The author can submit a written application to his/her department to terminate the agreement. Such termination will result in the document being removed from Brage.

1 Tillatelse til å publisere elektronisk materiale 
1.1 Forfatteren gir herved UMB en vederlagsfri, ikke-eksklusiv rett til å gjøre innlevert elektronisk materiale, nedenfor kalt materialet, tilgjengelig i elektronisk form via Brage, som innebærer publisering på Internett.
1.2 Forfatteren har satt seg inn i, forstår og aksepterer de konsekvenser en publisering via Internett medfører. Blant annet innebærer en slik tilgjengeliggjøring at andre nettsteder kan lenke til materialet. Hvis forfatteren har planer om å publisere materialet ved forlag eller i tidsskrift må forfatteren være klar over at dette kan ha konsekvenser når materialet også tilgjengeliggjøres i Brage. Se pkt. 3.3. 
2 UMBs plikter/ansvar 

2.1 UMB skal tilgjengeliggjøre materialet slik det ble levert til UMB, med tekst, tabeller, grafikk, bilder, multimedia med mer, men med de tekniske tilpasninger som anses nødvendig for publisering på Internett. 
2.2 UMB skal søke å beskytte materialet mot å bli endret av  uvedkommende/tredjepart, så langt dette er mulig i forhold til de tekniske løsninger vi benytter. 
2.3 UMB får ikke rådighet over materialet utover det som er uttrykkelig fastsatt i denne avtalen. 
2.4 UMB er ikke på noe vis ansvarlig for innholdet i materiale som er publisert via Brage, eller for forfatterens opptreden/handlinger for øvrig. UMB har ikke noe ansvar for eventuelle skader oppstått i sammenheng med denne avtalen, med mindre skaden/e skyldes forsett eller grov uaktsomhet fra UMB eller fra noen UMB svarer for. Ansvaret omfatter ikke i noe tilfelle indirekte skader. 

3 Forfatterens plikter/ansvar 
3.1 Forfatteren skal følge UMBs retningslinjer for publisering i Brage.
3.2 Forfatteren skal, ved inngåelse av avtaler med tidsskrifter, forlag osv. om tilgjengeliggjøring av materiale etter denne avtalen, søke å ivareta UMBs rettigheter etter denne avtalen best mulig. 
3.3 Forfatteren må selv klargjøre de konsekvenser en publisering av et materiale i Brage har i forhold til eventuelle forlag, tidsskrift eller andre rettighetshavere. 

Forfatteren garanterer for at han/hun er opphavsmann til innlevert materiale og har fullstendig råderett over dette i dets helhet. Hvis andre har rettigheter som utelukker publisering i elektronisk form via Brage uten tillatelser fra tredjepart, må forfatteren selv innhente nødvendige tillatelser fra disse. 
Om materialet har flere opphavsmenn (f.eks. flere forfattere), garanterer forfatteren som har innlevert materialet for at han/hun har innhentet de nødvendige tillatelser fra de andre opphavsmennene. 
Om materialet eller deler av materialet tidligere er publisert eller planlegges publisert i et tidsskrift eller ved et forlag, garanterer forfatteren for at han/hun har innhentet de nødvendige tillatelser fra tidsskriftet/forlaget. 
Om dokumentet eller deler av dokumentet inneholder fotografier, tegninger eller annet opphavsrettslig beskyttet materiale, garanterer forfatteren at han har innhentet de nødvendige tillatelser fra tredjemann på forhånd.
UMB råder forfatteren til å innhente skriftlige tillatelser fra medforfattere, tidsskrift, forlag eller tredjepart, og arkivere disse slik at de kan fremvises ved behov. 
3.4 Forfatteren garanterer for at materialet ikke har innhold som kan anses å stride mot gjeldende norsk rett, eller inneholder lenker eller koblinger til slikt materiale.
3.5 Dersom UMB skulle bli gjort erstatningsansvarlig overfor tredjepart på grunn av at forfatteren ikke oppfyller sine plikter etter denne avtalen, skal forfatteren holde UMB skadesløs. 
4 Overføring og opphør av avtalen 
4.1 UMB kan bare overføre sine rettigheter og/eller plikter i henhold til denne avtale til tredjepart såfremt forfatterens interesser etter avtalen blir ivaretatt i overføringsavtalen. 
4.2 UMB har en ubegrenset rett, på saklig grunnlag, til å avbryte tilgjengeliggjøringen av dokumentet.
4.3 Forfatteren kan skriftlig søke sitt institutt om å si opp avtalen. Dersom søknaden tas til følge vil dokumentet fjernes fra Brage.
